Mid 18th century; earliest use found in William Blackstone (1723–1780), legal writer and judge. From post-classical Latin non prosequitur he or she does not prosecute from classical Latin nōn not + prōsequitur, 3rd singular present indicative of prōsequī, in post-classical Latin sense of ‘to prosecute, institute legal proceedings against’.
